Next, state your response in one clear sentence. "I dispute the violation notice dated [date] regarding [specific alleged violation] because the allegation is factually inaccurate and the fine violates [cite statute]."

The meat of the letter is your legal argument. This is where most homeowners go wrong. Don't just say "I disagree." Instead:

1. Quote the exact statute or CC&R section the HOA relied on. 2. Explain why it doesn't apply to you. 3. Cite the statute or court case supporting your interpretation.

For example: "Your notice cites the 'landscaping rule' in Article 5.2 of the CC&Rs. However, that rule requires 'reasonable' maintenance, not perfection. Fla. Stat. § 720.309 requires fines to be for 'material violations.' A single dead plant is not material, especially since you enforce this rule inconsistently throughout the community."

If procedural violations occurred, lead with those. "The notice was dated January 1 but gave only 10 days to respond. Florida law requires 14 days (Fla. Stat. § 720.307). This violation is therefore void."

Request action: "I request written confirmation that this violation is withdrawn within 10 days. Otherwise, I will appeal to [your state ombudsman/independent committee/court] and seek recovery of costs."
